Does Impeachment Require a Crime?

By:

Popular commentary is suddenly awash with articles claiming that impeachment (and conviction and removal from office) do not require proof of a crime.

Examples include Ezra Klein at Vox (“High Crimes and Misdemeanors,” explained), Elizabeth Drew in USA Today (You don’t have to break a law to be impeached. Trump’s defenders need a better argument) and Frank Bowman in The Atlantic (The Common Misconception About ‘High Crimes and Misdemeanors’).  What’s notable from an originalist perspective is how originalist these articles are.

The Pathocracy of the Deep State: Tyranny at the Hands of a Psychopathic Government

By John W. Whitehead

Politicians are more likely than people in the general population to be sociopaths. I think you would find no expert in the field of sociopathy/psychopathy/antisocial personality disorder who would dispute this… That a small minority of human beings literally have no conscience was and is a bitter pill for our society to swallow — but it does explain a great many things, shamelessly deceitful political behavior being one.”—Dr. Martha Stout, clinical psychologist and former instructor at Harvard Medical School

Twenty years ago, a newspaper headline asked the question: “What’s the difference between a politician and a psychopath?

The answer, then and now, remains the same: None.

There is no difference between psychopaths and politicians.

What to Do When Compliance Is Not Enough? Police Defend Use of Taser, Chokehold & Excessive Force Against Man Who Complied During Arrest

MUSKOGEE, Okla. — Oklahoma police have asked a federal court to support their claim that citizens who comply with police during an arrest do not have a clearly established right to be free from police brutality. The police’s justification of the use of excessive force, even in the absence of provocation, were made in a motion by City of Muskogee police seeking the dismissal of a lawsuit filed by attorneys for The Rutherford Institute on behalf of Jeriel Edwards, an African-American man who, despite complying police orders during an arrest, was subjected to excessive force and brutality, including being thrown to the ground, tasered, and placed in a chokehold that rendered him unconscious and required his hospitalization for three days. The police officers’ motion seeks immunity from The Rutherford Institute’s Fourth Amendment lawsuit. In light of the fact that the beating Edwards was subjected to by police was clearly unreasonable and excessive, Institute attorneys have urged the court to reject the government’s justifications and claim of immunity.

Not all Sanctuaries are Cut from the Same Cloth

November 1, 2019

All gun control is a violation of your natural right to keep and bear arms.

Period.

And at a time like this, when efforts to ramp up restrictions on this right are ramping up at both the federal and state level, it couldn’t be more urgent to get things right when opposing them.

I know this won’t be a surprise to you. But a growing number of so-called “pro-2nd Amendment” politicians are misleading the public.

They Live, We Sleep: Beware the Growing Evil in Our Midst

“You see them on the street. You watch them on TV. You might even vote for one this fall. You think they’re people just like you. You’re wrong. Dead wrong.” — They Live

We’re living in two worlds, you and I.

There’s the world we see (or are made to see) and then there’s the one we sense (and occasionally catch a glimpse of), the latter of which is a far cry from the propaganda-driven reality manufactured by the government and its corporate sponsors, including the media.

The Tenth Amendment is Always the Right Answer

The Tenth Amendment is Always the Right Answer

I’ve been told that law students prepping for the Bar Exam are told that if the Tenth Amendment is ever among the answers on a multiple-choice question, they can immediately rule it out.

Future lawyers are told the Tenth Amendment is never the “right” answer.

Thomas Jefferson had a little different view of the Tenth Amendment. He called it the “foundation of the Constitution.”

“I consider the foundation of the Constitution as laid on this ground: That ‘all powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States or to the people.’ To take a single step beyond the boundaries thus specifically drawn around the powers of Congress, is to take possession of a boundless field of power, no longer susceptible of any definition.”

Richard Price: Torchbearer of Liberty

Richard Price: Torchbearer of Liberty

“Make way! Make way for the good Dr. Price!”

This is reportedly the familiar cry of farmers and tradesman who would greet Richard Price every morning as he would pass by their stalls at the marketplace. Today, there are PhDs in American history who have never heard of this man once known as the “Torchbearer of Liberty.”

There are scores of books published every year about the various men and movements that influenced the founding fathers of the United States, but there are few that even mention the celebrated Richard Price.

Richard Price is a name that every American who loves liberty and wants to more fully understand the true value of “so celestial an article as freedom” should know and whose words should be taught to every child in every home in the country whose liberty Dr. Price praised so fully and so frequently.

Donald Trump and Syria: A Tough Lesson About Power

Donald Trump and Syria: A Tough Lesson About Power

President Donald Trump taught a lot of people a tough lesson about power.

Within days of Trump announcing he was pulling troops out of northern Syria, Turkish forces launched an offensive against Kurdish fighters in the region. Trump immediately came under sharp criticism for “abandoning an important U.S. ally.” One Facebook commenter called the president’s actions “treason.”

“He has subjugated our foreign policy to the will of enemies. He has betrayed our partners at the request of our opponents in-theater. From a pragmatic perspective, you couldn’t get much more treasonous.”

Calling All Rosa Parks Americans

By Lloyd Marcus

The insanity going on before our very eyes regarding the Democrats’ and fake news medias’ latest campaign to impeach Trump over nonsense is infuriating millions of Americans. It is the equivalent of Adam Schiff flooding the airwaves with the lie that Trump stole his car and must be impeached for it. Meanwhile, Schiff’s car is parked untouched in his driveway for all the world to see. Ignoring the truth that Schiff’s car was not stolen, the Democrats and fake news media cart out a dozen witnesses (whistleblowers) who claim they saw Trump commit the crime.
